You represent and warrant that you own or have the right to submit the design, drawing, model, or prototype (“Model”) to use through the Website for the purpose of obtaining Services. You hereby grant 3DHUB-DnR a non-exclusive, transferable license to copy, modify, and use each Model that you submit through the Website solely for the purpose of providing the Services you have requested.

In the event that you modify contact information related to a Model, you further agree that you: a) are authorized or have authorized a person to modify contact information; b) have accurately entered all such contact information; c) You are solely responsible for the consequences of any errors in the entry of contact information; and d) You are solely responsible for all use of this website by anyone you designate to have access to such Models, including any changes made to Models.

PAYMENT AND FEES
You agree to pay all fees and any other charges incurred by you (including any applicable taxes) for the Services you have requested through the Website in accordance with the Order Terms and Conditions of Sale, hereafter OTCS (as applicable).

We reserve the right at any time to modify, edit, delete, suspend or discontinue, temporarily or permanently this Website (or any portion thereof) with or without notice. We will not be liable to you or to any third party for any such modification, editing, deletion, suspension, or discontinuance of this Website.

These TaC, together with our PP, the OTCS (as applicable), and all other click-through agreements you may enter into, which are expressly incorporated herein, contain the entire understanding between you and us with respect to use of the Website. Our failure to enforce any provision of these Terms and Conditions will not be deemed a waiver of such provision nor of the right to enforce such provision. In the event any provision of these Terms and Conditions is determined to be invalid, such invalidity will not affect the validity of the remaining portions, and the parties will substitute for the invalid provision a provision which most closely approximates the intent and economic effect of the invalid provision. These Terms and Conditions will be governed by and construed under the laws of the State of Florida in the United States of America, without regard to conflict of law principles. The Website is intended to be accessed by persons around the world, with no limitation of the geographic region. Access to, or use of, this Website may be prohibited by law in certain countries or jurisdictions. You are responsible for compliance with any applicable laws of the country from which you are accessing the Website. INTERNATIONAL COMPLIANCE

You acknowledge and certify that the data you are uploading to our servers including 3D CAD models and or drawings as well as your order DOES NOT include Export Controlled Data, without written prior authorization received by 3DHUB-DnR, from the owner of the data.

We have partnerships with manufacturers around the globe, and we provide you with all available options for you to make a choice. You understand that you have the option to select a manufacturer in another country, and by doing so you understand that your data will then be then transferred to that country for manufacturing. It is your responsibility to ensure that the manufacturer you select and the data you use, does not violate the International Compliance Rules and Regulations.

Under U.S. regulation, this includes technical data and/or end Parts which are controlled under the International Traffic in Arms Regulations, and/or subject to the Export Administration Regulations, and controlled at any level beyond EAR99.

Under E.U. regulation, this includes technical data and/or end Parts which are controlled under the Common Military List of the European Union and/or any EU Member State equivalent, or subject to the EU Dual Use Regulation 428/2009 or as amended by Regulation 2019/2199.

You further acknowledge and certify that you will only use our website in compliance with, and understand and agree with our policies, but you also agree your order does not and will not contain any weapons. “Weapons” is broadly defined as:

Firearms, firearm component parts, or ammunition. This includes any device which will or is designed to or may readily be converted to expel a projectile by the action of an explosive. Any device capable of being concealed on the person from which a projectile can be discharged through the energy of an explosive. Any component part integral to the safe firing of a projectile by means of an explosive from a device previously described. Ammunition including cartridge cases, primers, bullets, or propellent powder designed for use in any firearm.
Bladed weapons. This includes knives designed to cause bodily harm and any part or component thereof. A bladed weapon includes automatic knives, knives that are undetectable by a metal detector, stilettos, switchblades, butterfly knives, throwing knives, folding knives, gravity knives, and disguised knives.
Explosive devices. This includes grenades, rockets, explosives, incendiary devices, missiles, land mines, and related parts or components thereof.
Toy guns or other items with a weapon-like appearance. This includes paintball guns, airsoft guns, training weapons, mock guns, mock weapons, weapon replicas, and items that look like a gun or other weapons.
Weapons-related items and/or weapon accessories. Accessories, parts, or components to any weapon if that accessory/part/component contributes to the functioning of the weapon and/or attaches to the item.

The only exception to this rule is the customer has a written statement and or contract from law enforcement or government entity, which must be provided to us prior to placing the order.

3D-HUB-DnR will not and shall not be liable and/or responsible for violation of these terms. Violators will be reported to the appropriate agencies, and the user in question will be banned from further use of our website and/or services.
